The Physician’s Approval of the Medicinal Use of Cannabis

Although there are laws that protect the physician’s right to approve or recommend the medicinal use of cannabis, the physician still has significant risks and liabilities in approving a patient’s therapeutic use of cannabis.

The Attending Physician

To qualify as a participant in California’s Medical Marijuana Program, a licensed physician, in good standing with the Medical Board of California or the Osteopathic Medical Board, must approve or recommend the use of cannabis.

Under SB 420, the physician who approves or recommends the medicinal use of cannabis, is the “Attending Physician”.

Physician’s Risks and Liabilities

While the Medical Board of California recognizes medicinal cannabis as an emerging treatment modality, the Board continues to investigate and litigate physicians who are not following the Board’s guidelines for approving or recommending medicinal cannabis.

What the physician says to the patient regarding cannabis can be in violation of federal drug laws. There is the possibility of federal sanctions that could affect the physician’s DEA registration.

There is also a potential third party liability because the patient was not sufficiently informed regarding risks and side effects.

Patient’s Medical Record

Under the Medical Board guidelines, it is essential for the physician to have documentation of the medical condition for which the patient is seeking the use of cannabis.

If the physician is not the primary physician, the patient must provide a copy of that portion of their medical record that documents the medical condition for which medicinal cannabis may have therapeutic benefits.

By law, a patient is entitled to a copy of his/her medical record(s).

The Good Faith Exam

Under Medical Board guidelines, the physician is required to perform a good faith examination as a part of the medical cannabis consultation.

Risks, Side Effects and Informed Consent

An essential and required part of the physician’s consultation is the discussion of the risks and side effects related to the use of cannabis.

The patient should expect to sign an Inform Consent document that verifies the patient’s understanding and acceptance of the potential risks and side effects.

“Aiding and Abetting”

The cultivation, possession and use of cannabis, even for medical purposes, is currently illegal under federal law.

Federal law is very strict regarding what a physician can and cannot say. For example, the physician is permitted, by law, to discuss benefits and risks of medicinal cannabis; however, answering a question regarding “dosage” would be in violation of federal law and construed as “aiding and abetting” on the part of the physician.

The physician, including the physician’s employees, may not provide information regarding where medicinal cannabis might be obtained. Doing so would be a violation of federal law.

Physician’s Authorization to Exceed Limits

Under SB 420, the physician has the authority to extend the cultivation and possession limits.

At the same time, federal law prohibits the physician from discussing dosage or amount of cannabis to use. Doing so would be “aiding and abetting.”

SB 420 sets possession and cultivation limits at no more than 1/2 lb. of dried cannabis, in addition to 6 mature or 12 immature cannabis plants, per qualified patient.

Release of Medical Records

Before a Collective/Cooperative can provide medicinal cannabis, they are required to verify that the physician is licensed and the patient’s approval is valid.

In order for the physician to make this verification, the patient is required to sign a Release of Medical Records.

Physician’s “Verification” that Patient’s Approval is Valid

The patient’s access to medicinal cannabis can be delayed if the Collective/Cooperative operator is unable to verify that the patient’s approval or recommendation is valid.

Many physicians use a 24/7 on-line verification system to insure prompt verification.

Patient’s Healthcare Insurance

Under California’s Medical Marijuana Program, there is no requirement for governmental, private or any other health insurance provider or health care service plan to be liable for any claim for reimbursement for the medicinal use of cannabis.

Physician’s Professional Liability Coverage

Different malpractice carriers have different policies. Some refuse to insure for harms resulting from medications, including cannabis, that are not approved by the FDA.

How Does the Qualified Patient Obtain Medicinal Cannabis?

In accordance with the California Medical Association, physicians may refer the patient to Internet resources that provide a wide spectrum of information regarding cannabis.

Examples include: CANORML.org or MCCDirectory.org.

The Medical Cannabis Caregivers (MCC) Institute is a nonprofit Association founded in 2006 to provide Information, Resources and Classes for participants of State approved Medical Marijuana Programs.
The Medical Cannabis Caregivers Institute (MCC) has been approved by the California Department of Social Services (CDSS) to teach California's Medical Marijuana Program under the CDSS Continuing Education Program for Adult Residential Facility (ARF) administrator recertification.
